TERMS AND CONDITIONS FOR CONDUCTING THE GAME “Makaroon celebrates birthday.”

1.1. These Terms and Conditions (“Terms”) govern the manner in which the Game “Makaroon celebrates birthday.” (“Game”). The Terms and Conditions are available on the Makaroon.bg website – https://makaroon.bg/makaroonbg-praznuva-rojden-den.

1.2. The Organizer of the Game is “Makaroon” OOD, registered in the Commercial Register at the Registry Agency with UIC 205055198, with registered office and registered address: Sofia, Vazrazhdane district, 86 Osogovo Str., tel. 0899940820 (“Makaroon” or the “Organizer”).

1.3. The period of the Game is from 00:00:00 on 01.10.2025 to 23:59:59 on 31.10.2025 (“Conduct Period”).

1.4. The Game is organized and conducted in Bulgarian on the territory of the Republic of Bulgaria, in an online store – Makaroon.bg: https://makaroon.bg/

1.5. Participation in the Game is permissible subject to strict compliance with these Terms. By participating in the Game, the participant is deemed to be informed and familiar with its rules and agrees to the terms.

1.6. Information about the prizes can be found in Section 4 “Prizes” of these Terms.

2.1. The right to participate in the Game is open to all individuals with a permanent address in the Republic of Bulgaria who have reached the age of 18 on the date of participation, with the exception of employees of "Makaron" OOD, members of their families (including ascendants and descendents up to the second degree, spouses and relatives up to the second collateral degree), as well as persons who took part in the organization and conduct of the Game.

3.1. Each participant who has complied with these terms and conditions participates in the Game and has the opportunity to win:

- one iPhone 17 PRO phone;

- one Free VIP balloon flight for two for 30 minutes + video recording with a 4k action camera + a bottle of sparkling wine and a certificate near Sofia,

- one Unique gift: Dinner for two at Chef Manchev's

- one Weekend for two - two nights at SPA Hotel Bohema

- one Drift driving – 30 minutes

- 100 pcs. One-time discount vouchers on https://makaroon.bg worth 5 BGN each.

- 100 pcs. One-time discount vouchers on https://makaroon.bg worth 10 BGN each.

- 50 pcs. One-time discount vouchers on https://makaroon.bg worth 15 BGN each.

- 50 pcs. One-time discount vouchers on https://makaroon.bg worth 20 BGN each.

The prize vouchers will be active and can be used in the period from 05.11.2025 to 05.11.2026;

* The images of the prizes (shopping vouchers) displayed on the website and on all advertising materials are of illustrative nature. Prizes may differ from the images shown in the advertising materials.

**Discount vouchers cannot be combined with other vouchers, promotional codes or special offers, unless otherwise stated.

3.2. To participate in the Game, participants must shop at least once in the period 01.10.2025 - 31.10.2025 from the online store https://makaroon.bg . After making a purchase, each customer automatically participates in the Game.

Making more purchases brings an additional chance to participate in the game. Each order placed brings one chance to participate. Each participant can win only ONE prize.

3.3. The winners will be drawn randomly on 05.11.2025 by an independent team of Makaroon OOD. The draw will be held live on the Facebook channel of Makaroon.bg - https://www.facebook.com/makaroon.bg

3.4. The participants who have won a prize will be notified by phone call (from number 0899940820) or email (from office@makaroon.bg)

3.4.1. The winning participants will be contacted at the contact information provided by them within 20 (twenty) business days after the prize draw.

3.4.2. Participants with whom the Organizer cannot make contact within 5 (five) business days lose their right to receive their prize. In such a case, the Organizer will contact ONE reserve Participant, drawn by lot under the same conditions. If the Organizer cannot make contact within 5 (five) business days with the reserve Participant, the prize will not be awarded.

3.4.3. The Organizer is not responsible in case of impossibility to contact a winning Participant due to incorrectly filled in data or for other reasons beyond the Organizer's control.

3.4.4. The Participant who won the grand prize – Iphone 17PRO, will receive it by courier to the address specified by him/her within 10 (ten) business days from the date of specifying the delivery details. To receive his/her prize, the winning participant will have to sign a delivery and acceptance protocol and a return receipt, certifying that the prize has been successfully delivered. Participants who won vouchers from Makaroon.bg will receive the prizes at the email address specified during their participation within 10 (ten) business days from the contact of the Makaroon.bg team to clarify the details of receiving the prize.

3.4.5. The initials of the prize winners will be published onthe official website of Makaroon.bg – https://makaroon. bg/ after successfully connecting to them.

3.5. It is not allowed to exchange a won prize for its monetary equivalent or for another prize. The right to receive the prize cannot be transferred to third parties.

3.6. Discount vouchers can only be used once at the online store https://makaroon.bg. Prize vouchers:

3.7. In connection with the taxation of prizes that are not of insignificant value within the meaning of §1, item 62 of the Additional Provisions of the Personal Income Tax Act, the large prizes in this Game, namely the Iphone 17Pro, are subject to taxation with a final tax in accordance with Art. 38, para. 14 in conjunction with Art. 65, para. 7 Personal Income Tax Act, which is withheld and paid by the Organizer - at its expense. In fulfillment of its obligation under the Personal Income Tax Act, the Organizer is obliged to indicate the names of the winning Participant, his/her Personal Identification Number and permanent address in the report under Art. 73, para. 1, item 2 of the Personal Income Tax Act for the income paid during the year and tax withheld.

3.8. Upon receipt of the grand prize, the winning Participants must present an identity document for verification, as well as provide the Organizer with additional personal data – personal identification number and permanent address, in view of the Organizer’s obligation under Art. 73, para. 1, item 2 of the Personal Income Tax Act. Insofar as the need to process the additional personal data of the Winners is imposed on the Organizer by law, within the meaning of Art. 6, para. 1, letter “c” of Regulation (EU) 2016/679, consent to the processing of the Winners’ personal data is not required.

4.1. To participate in the Game, participants must shop at least once in the period 01.10.2025 – 31.10.2025 from the online store https://makaroon.bg . After making a purchase, each customer automatically participates in the Game.

4.2. Each participant, within the Game, has the opportunity to win only one prize specified in Art. 3, item 1.

4.3. The right to participate is not subject to transfer, offset or exchange for cash compensation.

4.4. In the event that a participant is drawn as a winner more than once, his place will be taken by a reserve participant drawn by lot under the same conditions.

5.1. By participating in the Game, participants agree to these Terms.

5.2. The personal data of all Participants in the Game are processed in accordance with the applicable legislation and the Organizer's internal policy for the protection of personal data and for the purposes specified in these Terms.

5.3. The Organizer, in its capacity as a Personal Data Controller within the meaning of the law, processes the personal data of the Participants for the purposes of conducting this Game.

5.4. The legal basis for the processing of data in connection with this prize game is Article 6, paragraph 1, letter f) of the General Data Protection Regulation (GDPR) - the Organizer's legitimate interest in conducting the game and distributing prizes.

5.5. Notwithstanding the provisions of Art. 5.4., participation in the Game also requires consent to the processing of the personal data specified below within the meaning of Article 6, paragraph 1, letter a) of the GDPR. Consent may be withdrawn at any time. Providing consent to the processing of the personal data described in these Terms, in the manner described in the Terms, is entirely voluntary, which means that if the participant does not wish to provide the personal data described, they will not be processed in the manner described, but at the same time it will be impossible for him to participate in the Game. Despite the withdrawal of consent, the Organizer may continue to process personal data on other grounds, such as a legal requirement, contractual relations or legitimate interest.

5.6. The data that will be processed in connection with participation in the game are: Name, Surname, Phone and email.

The data of winning participants that will be processed are: three names, Personal Identification Number, town, phone number and/or email address.

5.7. The personal data provided to and processed by the Organizer may be disclosed by it for the purposes of implementing the Game to third parties on the territory of the Republic of Bulgaria in compliance with the provisions of the current legislation

5.8. The personal data provided to and processed by the Organizer may be disclosed by it in compliance with mandatory regulatory provisions, such as the NRA.

5.9. Personal data collected in connection with participation in the Game will be stored for the following periods:

- *two names and city of residence of the winning participants in the event of a specialprize draw will be published on the website https://makaroon.bg/ for a period not exceeding 1 (one) year after successful connection with all winners;

*The names of the winning participants will be published with their initials, as well as the first 3 letters of their email (the remaining characters will be hidden)

- for accounting and tax purposes, the data of the winning participants will be stored by Makaroon for a period not exceeding 11 (eleven) years from the date of awarding the prize;

- the data of the reserve participants will be stored by Makaroon for a period of up to 1 (one) month after the drawing of the prizes;

- the data of the non-winning participants will be stored by Makaroon for a period of up to 1 (one) year, counting from the drawing, respectively the announcement of the winners of one of the prizes on the Makaroon website.

5.10. At any time, in compliance with the requirements of applicable law, by sending a specific letter to the address of Makaroon or to the email address: office@makaroon.bg, any person whose data is processed in connection with the game has the right to:

a) withdraw their consent to the processing of personal data with effect for the future, where the data processing is carried out on the basis of consent, without affecting the processing of personal data until the moment of withdrawal. In the event of withdrawal of consent, the personal data of the data subject will be deleted and/or will cease to be used for the purposes specified herein, unless the administrator proves that there are legitimate grounds for the processing that override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims;

* Withdrawal of consent before the date of the prize draw results in the automatic exclusion of the participant from the game and the cessation of the processing of their personal data for the purposes of the game.

b) inquire with Makaroon whether his/her personal data is being processed and to receive a copy of the processed data, as well as information about the purpose of the processing, as well as to whom they are or will be disclosed (right of access);

c) request the correction of an inaccuracy in his/her processed personal data or the completion of incomplete personal data in the event of a technical error or inaccuracy (right to correction);

d) request Makaroon to delete personal data relating to him/her for which there is no legal basis for processing, in respect of which he/she has withdrawn his/her consent to processing or against whose processing he/she has explicitly objected (right to erasure);

e) request Makaroon to restrict the processing of his/her personal data (i.e. the personal data shall continue to be stored by Makaroon, but shall not be processed in any other way) where the accuracy of the personal data is contested by the data subject or where the processing is unlawful and the data subject wishes his/her data to be stored for the purpose of defending legal claims (right to restriction of processing);

f) request Makaroon to provide the personal data concerning him/her in a structured, commonly used and machine-readable format (right to data portability); Apart from the above, the subjects of personal data have the right to file a complaint with the supervisory authority for personal data protection – the Personal Data Protection Commission (Address: Sofia 1592, 2 Prof. Tsvetan Lazarov Blvd., E-mail: kzld@cpdp.bg, Website: www.cpdp.bg), in case they believe that there is a violation of the applicable legislation for the protection of their personal data, and at any time they can contact the Data Protection Officer appointed by the administrator (Konstantin.prodanov@makaroon.bg).

5.11. By participating, the participants declare that, in compliance with the applicable legislation, they agree with the provisions of these Terms and Conditions regarding the processing of personal data for the purposes of participating in the Game.

5.12. For issues not regulated in these Terms regarding the processing of personal data by Makaroon, the Personal Data Protection Policy, available at: https://makaroon.bg/ in the section "Security and Personal Data Protection Policy and General Terms and Conditions", applies.

5.13. For issues relating to the processing of personal data that are not regulated in accordance with these Terms, the provisions of the applicable legislation apply.

6.1. The Organizer is not liable for damages that are not a direct and immediate consequence of participation in the Game or are a result of the inability of the Participants to connect to the relevant Internet server.

6.2. The Organizer is not liable for technical problems, such as, but not limited to, a crash of the information system, a power outage or a technical malfunction of the computer used by the Participant, as well as for unsuccessful attempts to access the Internet for any reason.

6.3. The Organizer is not liable for any damages or adverse consequences related to the use of a prize.

6.4. The Organizer has the right to terminate the Game at any time fordue to technical reasons and/or changes in applicable legislation, orders of competent state bodies, violation of these Terms (including those that lead or may lead to material abuse) and/or force majeure and/or other circumstances beyond the control of the Organizer, announcing this in an appropriate manner. If the termination of the Game is caused by a Participant in it, the Organizer may file a claim against him/her for compensation for the damage caused.

6.5. The Organizer is not responsible and is not obliged to maintain correspondence in connection with participations that were delayed, were impossible or unsuccessful as a result of technical problems with communication systems.

6.6. All Participants assume all costs incurred due to their participation in the Game (including - costs for Internet access).

6.7. Participants who do not comply with the Terms will be disqualified without further notice.

6.8. The Organizer is not liable for any losses and/or damages suffered by the Participant and/or a third party as a result of the Participant providing a false identity, entering false data or other similar actions for the purpose of more participation.

Participants who use a false identity in the Game and/or violate the Game mechanism in any way will be disqualified without further notice, losing the right to a prize won, if they were entitled to one.

7.1. In case of questions regarding the Terms, participants can send an inquiry to the following e-mail address: office@makaroon.bg. Complaints and reports in connection with the game are submitted to the same address. Anonymous complaints and reports are not considered by the Organizer.

7.2. The obligations of the Organizer of the game are exhausted with the provision of the respective prize to the winning participant, in accordance with the terms and conditions announced here.

7.3. The Organizer determines the rules of the game unilaterally and has the right to amend and supplement them at any time. Changes are announced by publishing the updated Terms of Conduct of the Game in the manner in which their original version was published. Each change comes into force from the moment it is announced.

7.4. The invalidity of individual texts of the Terms of the Game does not affect the validity and applicability of the remaining terms.

7.5. Applicable to the legal relations arising from the Game is the current Bulgarian legislation.
